Michael Mihm heads our plaintiff legal malpractice group. About Legal Malpractice Litigation

Legal malpractice cases are typically complex, because they can touch on any area of the law and on any industry involving a lawyer or law firm. They are usually multi-layered because they almost always involve an underlying business transaction or lawsuit. Not only must a court or a jury decide whether a lawyer acted improperly, they also must decide whether the plaintiff was harmed, which means analyzing the underlying transaction or lawsuit as well. Legal malpractice, in other words, is two cases in one.

Mr. Mihm has for many years served as the Managing Editor of Lawyers’ Professional Liability in Colorado, a 2-volume, 1,500 page treatise on legal ethics and lawyers’ professional liability law.   Nearly all of Ogborn Mihm’s trial lawyers have contributed chapters. Our lawyers also routinely teach and write on legal malpractice and professional ethics matters.

Featured Cases

Our lawyers obtained a $2.5 million jury verdict on behalf of the owners of a prominent Colorado retail business in a legal malpractice case arising out of an attorney’s breach of fiduciary duty when aiding a trustee in an attempt to seize control of the family-owned company.

Ogborn Mihm lawyers obtained a $12.8 million jury verdict in state district court of Salt Lake City, Utah.  The verdict, then one of the largest plaintiff legal malpractice jury verdicts in U.S. history, arose out of a prominent law firm’s mishandling of a development application for an 8,650 acre ranch near Park City, Utah.
